Trainer Agreement
Agreement in consideration of receiving training from Howatt HR Consulting to deliver the Crisis-Ready Interventionist Certification (the “Program”), the receipt and sufficiency of which is acknowledged, I, hereby agree as follows:
1. None of the documents, manuals, books, information, or other materials provided to me in the course of my training or at any other time that relate to the Program (the “Materials”) may be reproduced or disseminated to any 3rd party in any form, in whole or in part, without the express written permission of Howatt HR Consulting and Dr. Bill Howatt (“the Copyright Holders”).
2. The Materials will not be amended or varied in any manner without the express written permission of the Copyright Holders. I acknowledge that this restriction is essential to maintain the integrity of the Program and the Materials.
3. I acknowledge and agree that:
Use of unauthorized variations of the Materials may cause adverse effects on the Program participants, and I hereby agree to indemnify the Copyright Holders and hold them harmless from any actions, proceedings, suits, or liability that may arise or be suffered by them by virtue of my unauthorized alteration of the Materials.
All use of the Materials must be conducted in strict compliance with all applicable laws and organizational policies, and it is my duty to both adequately apprise myself of all applicable laws and policies and to conduct myself strictly in accordance with the same in my use of the Materials.
When delivering the Program, I will:
do so in a competent, diligent, respectful, safe, and prudent manner; and
use the most current version of the Materials that the Copyright Holders have provided to me.
The Copyright Holders shall not be liable for any of my actions, errors, or omissions in delivering the Program.
4. I acknowledge and agree that when I make use of the Materials and/or lead the Program, I will be doing so independently and not on behalf of the Copyright Holders, As such, I am (or my employer is) solely responsible for any liability arising from my use of the Materials and/or conduct of the Program and any claim that a participant in the Program may have as a result of my (or my employers) acts or omissions. I hereby indemnify and agree to indemnify and hold the Copyright Holders harmless from any claims arising from my acts or omission, including in respect of my use of the Materials and/or my the conduct of the Program. I hereby release the Copyright Holders from all such liabilities and claims.
5. I acknowledge that I have been advised by Howatt HR Consulting that I (or my employer) should consider maintaining insurance (such as comprehensive general liability insurance) to address any such liabilities or claims.
6. Only participants who attend and complete the full course Program as prescribed by the Copyright Holders will be deemed to have successfully completed the entire Program.
7. I will send to Howatt HR Consulting within 5 days of completion of each Crisis-Ready course to receive credit
(i) Attendance
(ii) Encourage Participants to Complete Online feedback forms
8. I acknowledge that if concerns arise from evaluations and/or other feedback, my status as a certified Trainer may be suspended or revoked.
9. I agree to study the Materials to the level and quality of delivery that I have been trained.
10. The program can be delivered as follows:
Certification course (12 hours - including breaks) in-person or virtually
4 sessions of 3 hours within 4 weeks
4 sessions of 3 hours 12 months
With a badge after each session
11. To maintain certification, I agree and acknowledge that I must deliver the Program to at least 200 participants per year. The trainer year is determined by the month of the Train-the-Trainer, i.e., if I attend a Train-the-Trainer in October, then I agree and acknowledge that I must train a minimum of 200 participants by end of October each following year.
12. By signing this agreement, I agree to abide by the following guidelines:
(i) Group size for virtual course delivery: a minimum of 8 and a maximum of50 participants
(ii) Group size for in-person course delivery: a minimum of 8 and a maximum of 50 participants
(iii) Program credits will not be given for groups with less or more participants than the required group size range, as elaborated by the in-person, virtual course delivery, unless approved by a Master Trainer directly.
(iv) No more than 2 Trainers will be permitted to deliver any Program course. When co-facilitating the Program, all designated Trainers must be present for the entire course regardless of how the course is delivered without exceptions
13. I will either retain or return any Materials provided to me by the Copyright Holders but will not sell, give, or otherwise transfer such materials to any third party. Only authorized trainers are entitled to have and/or use the Materials.
14. I agree that should I have any concerns, recommendations, or suggestions about the Program I will promptly provide such feedback to Howatt HR Consulting or my respective Master Trainer.
15. I acknowledge that I will have reasonable access toHowatt HR Consulting’s team for support and coaching.
16. I acknowledge and agree that it is my responsibility to communicate my updated contact information to Howatt HR Consulting.
17. I finally agree to:
(i) adopt any updates or modifications provided to me by Howatt HR Consulting;
(ii) undergo additional training requested by Howatt HR Consulting; and
(iii) become re-qualified to deliver the Program if requested by Howatt HR Consulting.
18. This Agreement shall be governed and interpreted with the laws of the Province of Nova Scotia, Canada. Additionally, any litigation arising from this Agreement, in the course of training, and/or leading the Program shall be litigated in the Province of Nova Scotia, Canada.
